Civil Marriage in Spain

Most countries legally recognise a Spanish marriage
(Both Civil & Religious Ceremonies & Gay Marriage since 2005)

One person, needs to be Resident locally for 2 years, if neither are a Spanish citizen

So foreigners & non residents often choose a civil marriage at home. Then hold a Wedding Style celebration here in Spain.

An official translation of their (UK) marriage certificate can be used, where officially needed, by non residents living in Spain

Spanish Civil Marriage

Official ceremony has to be at the Town Hall (Ajuntament)
or at the Registry Office (Registre Civil). Not at a private location.

(applied from Town Hall in advance)
(Certificado de Capacidad Matrimonial)

Which involves your:

  • Certificate of Residence (Padró Municipal d’Habitants)
    One person, needs to be Resident locally for 2 years
  • Passport, NIE (Foreign Identity Number),
    Foreign Residence Card (Tarjeta de Residencia)
    or DNI (Spanish National ID card) + photocopy
  • Birth Certificate (from Foreign Office, if UK)
    Stamped with a Hague Apostille and legally translated into Spanish
  • Free To Marry Declaration (if a Foreign Passport Holder, from own Consulate)
    Confirming not married in home country/no other impediment to the marriage. (can take over 21 (working) days to arrange
  • If Married Before
    Previous marriage certificate divorce certificate or spouse’s death certificate. Stamped with a Hague Apostille and legally translated into Spanish

Town hall/registry office/district court/religious authority often decide any additional local rules
